1.0 Purpose

This policy has been developed to describe measures taken by the MBL to achieve effective compliance with Massachusetts Department of Public Health (DPH) and United States Environmental Protection Agency (EPA) regulations designed to protect children under the age of six from exposure to lead-based paints. Nothing in this policy prohibits the MBL Housing Office from establishing other policies that limit which units are rented to families with children.

2.0 Status of MBL Housing

    2.1 The following units are known to contain lead paint and may not be rented to families with children under the age of six except as provided for under section 3.0 Exemptions. Except as noted, these units have been inspected by a licensed risk assessor.

        2.1.1 Ebert Hall

        2.1.2 The Brick Apartment Building

        2.1.3 Devils Lane Cottages #s 10, 12, 13, 14, 15, 16, 17, 18, 25, 26, 27, 28

        2.1.4 331 Oyster Pond Road (DL#1, head caretaker’s residence)

        2.1.5 F. R. Lillie Road # 43 and 47 (2 cottages)

        2.1.6 Crane House, 63 Millfield Street

        2.1.7 Veeder House (not inspected)

        2.1.8 David House (not inspected)

        2.1.9 Drew House (not inspected)

3.0 Exemptions

    3.1 Rooming House Exemption

    DPH regulation 105 CMR 460.100(E) exempts certain dwelling units and rooming houses from the provisions of 105 CMR 460, their Lead Poisoning Prevention and Control regulations.

        3.1.1 Families with children under six may be housed in Ebert Hall, Veeder House, Drew House, David House, or in any of the units in the Brick Apartment Building which do not have kitchen facilities.

        3.1.2 Each tenant with children under six staying in a unit covered by this exemption shall be offered a copy of the MBL’s Lead Paint Notification.

    3.2 Short Term Rental Exemption

    DPH regulation 105 CMR 460.100(D) exempts certain dwelling units rented on a short-term basis from the provisions of 105 CMR 460, their Lead Poisoning Prevention and Control regulations.

        3.2.1 Brick Apartment Building apartments with kitchens, Devils Lane Cottages, F.R. Lillie Road Cottages, and Crane House, that contain lead-based paints may be rented to families with children under six provided the conditions in sections 3.2.2 – 3.2.4 are met.

        3.2.2 Term
        No child under six may occupy any unit exempted under this section for more than 31 days in any 12-month period.

        3.2.3 Notification
        Each tenant with children under six staying in a unit covered by this exemption shall be offered a copy of the MBL’s Lead Paint Notification.

        3.2.4 Annual Inspections
        Visual inspections of each unit rented under the short term rental exemption must be made on an annual basis. Any peeling, chipping, flaking paint, deteriorated plaster or putty shall be made intact. Records of these inspections shall be maintained.
